Procurement in a Nutshell – Procurement Act 2023: Go Live Date Change

The Government has announced that the intended 'Go Live' date for the new Procurement Act 2023 has changed. The Act is now expected to come into force on the 24th February 2025 (instead of the previously announced date of 28th October 2024).

It is the Government’s intention to introduce regulations to confirm this new date for the commencement of the Act. Contracting authorities should note that existing procurement legislation, which includes the Public Contracts Regulations 2015, will apply until the new regime goes live (now February 2025), and will also continue to apply to those procurements which are ‘commenced’ under the 2015 regulations. For our analysis on the commencement and transitional guidance in relation to the new regime, please click here.

A new National Procurement Policy Statement (NPPS) will also be developed. The Government has stressed that the new procurement regime should commence with a statutory NPPS which is aligned to the new Government’s ‘strategic priorities’.

The Ministerial Statement announcing the changes discussed above can be found here.
